Draft for review. Bracketed items are placeholders that need confirmation before this policy is published.
About us and these terms
This website is run by [COMPANY NAME LTD] ("KasaRokk", "we", "us" or "our"), registered in [England and Wales] under company number [NUMBER], with its registered office at [REGISTERED ADDRESS]. [We are registered for VAT under number [VAT NUMBER].] [Our redress scheme and client money protection details are in section 15.] These terms apply whenever you use [WEBSITE URL], our enquiry and booking forms, and any online features we provide (together, the "Site"). By using the Site you agree to them. If you do not agree, please do not use it. If you later enter into a separate written agreement with us, such as a tenancy, sale, letting or management agreement, that agreement takes priority over these terms where the two conflict. Please also read our Privacy Policy and Cookie Policy, which explain how we handle your information.
Using the Site
You must be at least 18 and able to enter into a binding contract to use the Site for anything other than general browsing. You agree to use the Site lawfully and in line with these terms. You must not:
- Use the Site in a way that is unlawful, fraudulent, discriminatory or harmful.
- Copy, scrape, harvest or systematically extract listings, photographs or contact details, whether by hand or with automated tools, without our written permission.
- Introduce viruses or other harmful code, or try to gain unauthorised access to the Site, our systems or other users' accounts.
- Interfere with the Site's security, performance or availability.
- Pretend to be another person or organisation, or give false details in an enquiry.
- Use the Site or any contact details on it to send unsolicited marketing.
We aim to keep the Site available but do not promise it will always be uninterrupted or error-free. We may suspend or change it for maintenance or other reasons.
Accounts
Some features, such as saved homes or alerts, may need an account. If you create one, you agree to give accurate and current information, keep your login details confidential, and tell us straight away if you think someone else has used your account. You are responsible for activity under your account unless it happened because of our failure to protect it. We may ask you to verify your identity before we provide certain services, for example where the law requires it. You can close your account at any time by contacting us.
Our services and our role
KasaRokk helps people find, view, buy, sell, let and rent residential property [EDIT TO MATCH YOUR SERVICES]. On the Site we act as an intermediary between property owners and people looking for property. Unless we tell you otherwise in writing, we are not a party to any sale, tenancy or other contract between you and an owner, landlord, seller or tenant. Nothing on the Site is legal, financial, tax, mortgage, surveying or investment advice. Please take your own professional advice, for example from a solicitor, conveyancer, surveyor or mortgage adviser, before making a decision.
Property information
We work hard to make listings accurate and to include the material information a buyer or renter needs to make an informed decision. Descriptions, photographs, floor plans, measurements and prices come from owners and our own checks, and may change. Please treat them as a guide, not a promise.
- Properties may be sold, let or withdrawn before we update the Site.
- Photographs and floor plans are for illustration. Sizes are approximate and furniture and fittings shown may not be included.
- We have not tested appliances, services or facilities, and we do not confirm tenure, planning status, building regulations or compliance unless a listing says so.
- Please check everything that matters to you, including by viewing in person and through your solicitor or surveyor, before you commit.
If you spot an error in a listing, please tell us and we will correct it promptly.
Viewings, offers and enquiries
When you ask to view a property or make an enquiry, we will pass your request to the relevant owner or agent and try to confirm a time with you. A viewing request is not a booking until we confirm it, and it can be cancelled or rearranged by either side, for example if the owner withdraws the property. An offer you make through us is not binding on the owner until they accept it, and no sale or tenancy is binding on either side until contracts are exchanged or a tenancy agreement is signed, as the law requires. Any holding deposit or reservation fee is covered by the written terms you are given when you pay it.
Fees and payments
Using the Site to browse, search and enquire is free. Where we charge for a service, we will tell you the fee, what it covers and whether VAT applies before you commit. Our fees are set out [on our fees page at [FEES URL] and] in our written terms of business. We do not charge tenants fees that are banned by the Tenant Fees Act 2019, or by the equivalent law in Wales or Scotland. Permitted payments, such as a holding deposit, a security deposit and rent, are explained in writing before you pay. Where you pay us online, payments are processed by [PAYMENT PROVIDER]. We do not store your full card details. If you are owed a refund, we will return it using the same method you paid with unless you agree otherwise.
Your content and conduct
If you send us content, such as messages, reviews, documents or photographs, you confirm that it is accurate, that you have the right to share it, and that it does not break the law or anyone's rights. You give us a non-exclusive, royalty-free licence to use it as needed to provide our services and to display it on the Site if you have asked us to publish it, for example a review or a listing photograph. We may remove or decline to publish content that is unlawful, offensive, misleading or breaches these terms. Please do not send us anything that includes other people's sensitive personal information.
Intellectual property
The Site and its content, including the KasaRokk name and logo, text, design, graphics, software and our own photography, belong to us or our licensors and are protected by copyright, trade mark and other laws. Listing photographs and floor plans may belong to the owner or a photographer and are used with permission. You may view the Site and print or save extracts for your own personal, non-commercial use, such as considering a property. Any other use, including copying, republishing, selling or creating derivative works, needs our prior written permission.
Third-party links and services
The Site may link to or use third-party services, such as maps, mortgage calculators, referencing providers, social media and messaging apps. We do not control them and are not responsible for their content, availability or practices. Using them is at your own risk and subject to their own terms.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded, including your statutory rights as a consumer. Subject to that:
- We are responsible for losses you suffer that are a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for losses that are not foreseeable.
- If you use the Site as a consumer, we only provide it for domestic and private use. We are not liable for loss of profit, business, revenue or opportunity.
- If you use the Site for business purposes, we are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss, and our total liability to you in connection with the Site is limited to [£X] or the fees you paid us in the 12 months before the claim, whichever is higher.
- We are not liable for the acts or omissions of owners, landlords, sellers, tenants or other third parties, or for loss caused by events outside our reasonable control.
Consumer rights and cancellation
If you are a consumer, you have legal rights under the Consumer Rights Act 2015, including that services must be provided with reasonable care and skill. These terms do not affect those rights. If you buy a service from us online, by phone or away from our premises, you may have the right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start work during that period, you may have to pay for the work already done. The terms of each paid service will explain your cancellation rights and how to use them.
Suspension and termination
We may suspend or close your access to the Site or your account, with or without notice, if you seriously or repeatedly break these terms, if we reasonably suspect fraud or misuse, or if the law requires it. Where it is reasonable to do so, we will tell you why and give you a chance to put things right. You can stop using the Site at any time. Sections that by their nature should continue, such as intellectual property and liability, will carry on after your access ends.
Changes to the Site and these terms
We may update the Site, our services and these terms from time to time, for example to reflect changes in the law or our business. The "as of" date at the top shows when these terms were last revised. If we make a material change, we will give you reasonable notice. Continuing to use the Site after a change takes effect means you accept the updated terms, but this does not affect any right you already have to cancel a paid service or to end a contract under its own terms.
Complaints and redress
If you are unhappy with our service, please tell us at [complaints@YOURDOMAIN] or at the address in section 17, giving your name, contact details and what went wrong. We will acknowledge your complaint within [3] working days, investigate it, and aim to send you a full reply within [15] working days. Our written complaints procedure is available on request. If we cannot resolve your complaint, you may be able to refer it to an independent redress scheme. We are a member of [THE PROPERTY OMBUDSMAN / PROPERTY REDRESS SCHEME / OTHER APPROVED SCHEME], membership number [NUMBER]. [Where we handle client money for lettings, we are covered by the client money protection scheme [SCHEME NAME], membership number [NUMBER].]
General and governing law
- Entire agreement: these terms, together with our Privacy Policy, Cookie Policy and any written agreement for a specific service, are the whole agreement between us about the Site.
- Severance: if any part of these terms is found unlawful or unenforceable, the rest stays in force.
- No waiver: if we do not enforce a right straight away, we have not given it up.
- Assignment: we may transfer our rights and obligations under these terms to another organisation, and will tell you if we do. You may not transfer yours without our written consent.
- Third parties: only you and we have rights under these terms. Nobody else may enforce them under the Contracts (Rights of Third Parties) Act 1999.
- Governing law: these terms, and any dispute or claim arising from them or the Site, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring a claim in the courts of that country, and if you are a consumer you keep any mandatory rights of your home country.
